Terms and Conditions

These terms and conditions (“Terms and Conditions”) set out the rules for having an account and placing bets with BetFlash and any restrictions or conditions that will be imposed on you.  It is very important for you to understand and agree to be bound by these rules before you enter into a transaction with BetFlash.

 

  1. In these Terms and Conditions –

    “ante-post bet” means any bet accepted by BetFlash on horseracing, sport or other event or contingency before the final field is declared;

    “BetFlash” means BetFlash (Pty) Ltd, a private company duly incorporated under the laws of South Africa, with registration number 2011/135672/07, and the holder of a bookmaker licence issued by the Western Cape Gambling and Racing Board;

    “Business Day” means any day other than a Saturday, Sunday or public holiday officially recognised in South Africa;

    Combination bet ” means a bet placed as a simultaneous prediction of outcomes of events which are completely independent of each other, and in respect of which –

    1. the winning amount is the amount of the bet wagered multiplied by the combined odds;
    2. the total odds are calculated as a multiplication of all the odds of all event outcomes included in such combination bet, and
    3. a winning outcome requires all outcomes of all the events included in such combination bet to have been predicted correctly by the Customer;

    “Connected bet” means a bet in respect of which the same selection is picked for two or more different events;


    “Customer” means any person who applies for a Player Account, in whose name a Player Account is opened, or who places a bet with BetFlash, as the context may indicate;

    “event” means any sporting contest or other event or contingency in respect of which betting is offered by BetFlash;

    fixed-odds bet ” means a bet on one or more contingencies in which odds are agreed at the time the bet is placed;

    “fixed place bet” means a place bet at fixed odds that are agreed upon prior to the event subject to there being no deductions or dead heats;

    “fixed win bet” means a win bet at fixed odds agreed upon prior to the event, provided that there are no deductions or dead heats;

    key bet ” means a “place bet” where the first two positions count;

    lay a bet ” means the acceptance of a wager and a potential financial loss by BetFlash should the bet win;

    “in-running betting”
    refers to circumstances where quotes or prices on selected events, outcomes or contestants are updated during the progress of the event on which wagering is accepted, in such a manner that betting may occur after the official start but before the official end of an event;

    “in-running market”
    means any market in respect of which in-running betting is offered by BetFlash;

    “limits”
    means such minimum or maximum amounts as may be stipulated by BetFlash in respect of stakes, betting markets, specific bet types, odds or payouts, as the case may be;

    “long-term market” means a betting market created by BetFlash in respect of a series of events occurring over an extended period of time;

    match play ” means any sporting event limited to two participants;

    match race” means a horse race limited to two participants;

    multiple bet ” or “ multiple event bet ” or “ all to come ” (“ ATC” ) means more than one selection in different horse races, sporting events or contingencies, combined to form one bet;

    open bet ” means—

    1. a bet, other than a totalisator bet, taken by a bookmaker on one or more contingencies, in which no fixed-odds are agreed at the time the bet is placed; or

    2. a bet in respect of which the payout is determined after the outcome of the contingency on which such a bet is struck became known, with reference to dividends generated by a totalisator;

       

    other contingency ” means any lawful event or contingency in respect of which BetFlash may lay bets, other than horseracing or a sporting contest;

    “Party”
    means BetFlash on the one hand, or the Customer on the other, as the context may indicate, and
    “Parties”
    shall mean the two collectively;

    place a bet ” means to place a wager with BetFlash in the anticipation of a financial gain should the bet win;

    place bet ” means a bet on a participant being placed in accordance with the Rules of the particular race, sporting event or contingency;

    “Player Account”
    means an account opened in the name of the Customer by BetFlash for the purposes of betting, as more fully described in these Terms;

    related bet” means any bet in respect of which the outcome of one part of such bet contributes directly to the outcome of the other;

    Rules ” means these Terms and Conditions, both collectively and individually;

    scratching or withdrawal ” means a participant who or which has been withdrawn from a particular race or event prior to the start thereof;

    single bet ”, “ single event bet ” or “ordinary bet” is a selection of a single contestant for a bet in a horse race, sporting event, other event or contingency;

    starting price win bet ” (or “ SP Win bet ”) means a bet where the odds are the official fixed price of the selected contestant at the time of commencement of the event and the bet is successful when the selection is placed first in the event. Official Fixed price may be subject to deductions and/or dead heats;

    “stake”
    means the monetary outlay made by the Customer in placing a bet;

    “spread”
    means an index or range of potential measurable outcomes set by BetFlash from time to time in relation to any event on which spread betting is offered;

    “spread betting”
    means a system or form of betting in respect of which the Customer bets on whether a specified outcome will be above or below the spread;

    “stop loss”
    means an instruction by the Customer to BetFlash to close a bet if the value of the spread moves against the outcome specified by the Customer by a specified amount;

    “stop win”
    means an instruction by the Customer to BetFlash to close a bet if the value of the spread moves in favour of the outcome specified by the Customer by a specified amount;

    “these Terms”
    means these Terms and Conditions, and shall include such amendments as may be made thereto from time to time, and

    “totalisator”
    means a system of betting in which the aggregate amount staked on such event or combination of events, after deduction from such aggregate amount of any amounts which may in terms of legislation be deducted there from, is divided amongst those persons who have made winning bets on any event or combination of events in proportion to the amounts staked by such persons in respect of such winning;

    winning bet” means any bet in respect of which the Customer correctly predicted the result of the event or contingency or combination thereof in respect of which the bet was placed, and

    “with a run bet ” or “ given a run bet ” is any bet accepted by a bookmaker after the final field is declared.

     

  2. Words importing: -
    1. any one gender include the other genders;
    2. the singular include the plural and vice versa ;  and
    3. natural persons include legal entities and vice versa .
  3. lause headings in these Terms are inserted purely for convenience and shall not be taken into account in the interpretation of the contents of the Clauses to which they relate.
  4. If any provision of these Terms is void, that provision will not affect the validity of the remaining provisions of these Terms.
  5. Where any term is defined within the context of any particular Clause in these Terms, the term so defined, unless it is clear from the Clause in question that the term so defined has limited application to the relevant Clause, shall bear the meaning ascribed to it for all purposes in terms of these Terms, notwithstanding that that term has not been defined in this interpretation Clause.
  6. If any provision in a definition is a substantive provision conferring rights or imposing obligations on any party, notwithstanding that it is contained in the definition Clause, effect shall be given to it as if it were a substantive provision in the body of the agreement.
  7. Any number of days or months provided for in these Terms shall be counted exclusively of the first and inclusively of the last day or month unless the last day is not a Business Day, in which case the last day shall be the immediately following business day.
  8. The rule of interpretation that a contract, or any part of a contract, is to be interpreted against the Party responsible for the drafting or preparation of the contract, shall not apply and the Parties hereby waive reliance on such rule of interpretation.
  9. The words “include” and “including” shall be construed as being by way of example or emphasis only and shall not be construed as, nor have the effect of, limiting the generality of any preceding word/s.
  10. The words “other” and “otherwise” shall not be construed eiusdem generis with any preceding words where a wider construction is possible.

SECTION A: GENERAL PROVISIONS

  1. Eligibility to bet

    No person may apply for an account or place a bet with BetFlash (Pty) Ltd (“BetFlash”) or enforce any debt arising out of a bet unless that person -

    1. is a natural person (companies, close corporations and other corporate entities are disqualified from betting) with full capacity to contract;
    2. is 18 years of age or older, BetFlash reserves the right to ask for proof of age ;
    3. has completed in full an account application form, complied with FICA requirements and been accepted as an account holder by BetFlash;
    4. is not listed on the register of excluded persons referred to in section 14 of the National Gambling Act, 2004, and
    5. is not in breach of these Terms and Conditions.

     

  2. Application Process

    1. A Customer wishing to open a Player Account with BetFlash shall complete the Player Account application form posted on the BetFlash website, as amended from time to time.
    2. The Customer warrants that all information provided in the Player Account application form completed by him/her is and shall remain true and correct. The Customer undertakes forthwith, and in writing, to advise BetFlash of any changes in –

      1. the details provided on the Player Account Application Form;
      2. the Customer’s legal status or capacity;
      3. the Customer’s creditworthiness, or
      4. the Customer’s eligibility to bet
      or any other matter that may reasonably be expected to have a bearing on the Customer’s capacity or ability to manage the Player Account.
    3. In the account application form, the Customer shall indicate whether the Customer wishes to bet against –
      1. a cash deposit placed with BetFlash by the Customer from time to time, or.
      2. an amount of cash to be drawn by BetFlash as a deposit from the Customer’s credit card account.
    4. Any person who completes the account application form warrants that he/she has read, understood and accepted these Terms and Conditions and all Rules relating to betting on sporting events or horseracing or any other lawful contingency published on www.BetFlash.co.za/Betting_Rules as posted from time to time. Completion of an account application form amounts to an application requesting BetFlash to –
      1. conclude an agreement in accordance with these Terms and Conditions for the provision of a horse racing and sports betting service to such person (referred to as  “the Customer”); and
      2. to open an account in the name of the Customer.
  3. FICA
    1. BetFlash is bound by the provisions of the Financial Intelligence Centre Act, Act 38 of 2001, as amended (“FICA”), which sets out the requirements in relation to customer registration and identification, withdrawal and deposit procedures and deposit, withdrawal, wager and winnings limits. Where FICA or its associated regulations and instruments specify such procedures and/or limits then BetFlash will be operated in accordance with such procedures and/or limits. Where FICA does not specify such procedures and/or limits then BetFlash shall implement its own procedures and/or limits (subject always to any applicable legislation and/or regulations) in accordance with good corporate governance and the promotion of socially responsible gambling.     2. BetFlash will establish business relationships only with natural persons.
    3. Where new business relationships are established with a Customer, BetFlash shall require proof of the Customer’s full name, date of birth, residential address and nationality (in the case of a foreign national).
    4. Once a business relationship has been established with a Customer, an account will be created in the name of the Customer and the Customer will be required to log in to this/her BetFlash account for the purpose of entering into betting transactions with BetFlash, using his/her personalised login details, including a dedicated user name and password.
    5. If there is any difference between the information entered by a Customer at the time of logging in to his/her account, and the information supplied to BetFlash by the Customer at the time of establishing the business relationship, the Customer will not gain access to his/her account and will be required to contact BetFlash for assistance.
    6. The following procedures will be followed by BetFlash in relation to a Customer in respect of whom proof of identification and residential address is required:

      1. Where a Customer presents his or her identification document (ID or passport) in person, BetFlash shall make a photocopy of such document on the licensed premises, which shall be filed and retained for record purposes.
      2. Where an identification document is transmitted to BetFlash via facsimile transmission or by normal or electronic mail, such documents will be required to be current (unexpired in the case of passports) and certified as true copies of the original.
      3. A driver’s licence may be accepted as proof of identification, provided that:
        • a photograph of the bearer;
        • the full names or initials and surname of the bearer;
        • the date of birth of the bearer, and
        • the Identity Number of the bearer.
      4. Utility bills and similar documents submitted as proof of residential address shall be dated no earlier than three (3) months of the date of submission to BetFlash thereof.
    7. BetFlash is required to report single cash transactions above R24 999 to the Financial Intelligence Centre (“FIC”).
    8. BetFlash is further obliged to make reports to the FIC in the event of –
      1. Suspicious or unusual transactions, and
      2. Transactions entered into by persons suspected of intending to commit or of having committed any offence contemplated in the Protection of Constitutional Democracy against Terrorist and Related Activities Act, 2004.
  4. Accuracy of Account Information

    The Customer warrants that all information provided in the account application form completed by him/her is and will remain true and correct. BetFlash will rely on this information. If any information provided by the Customer is found to be incorrect or untrue, the Customer will be liable to pay for any damages suffered by BetFlash. The Customer undertakes to advise BetFlash, in writing, of any changes in details that might have an effect on an approved application or the Customers’ creditworthiness, legal capacity or continued eligibility as a customer.

  5. Application Procedures
    BetFlash –

    1. reserves the right to –
      1. accept an application for a new account;
      2. decline an application for a new account for any reason whatsoever;
      3. stop accepting bets, close or suspend an account from a Customer in its sole discretion for any reason, which reason BetFlash will not be obliged to furnish or disclose to the Customer or any other person, and
    2. may decline an application for a new account if –
      1. the account application form has not been completed in full, and/or
      2. the information contained in the account application form is found to be incorrect or important information has been left out, and/or
      3. any information required to be submitted together with the application form, or requested by BetFlash before or after the submission of the application form is not provided by the Customer in the manner or format or within the timeframes specified by BetFlash.
  6. Responsibility for account-related information

    1. The Customer is solely responsible for the safekeeping and proper use of all his/her account details and other information that will enable him/her to place a bet. The Customer undertakes that he/she will –
      1. not apply for or hold more than one account with BetFlash ;
      2. not apply for an account in the name of or on behalf of any other person, and
      3. not permit or enable any other person to place a bet, directly or indirectly, using the Customer’s account reference number, user name or personal identification number issued to the Customer by BetFlash from time to time.
    2. BetFlash will accordingly not honour any transaction involving any account described in 5.1 above or pay out any winnings in respect of any bet placed in relation to such an account. The Customer will be responsible to pay for any claims, losses or damages incurred by BetFlash arising out of the Customer or any other person’s use of an account contrary to this clause 5.
    3. The Customer undertakes to notify BetFlash immediately if the Customer’s account information is lost, stolen, misappropriated, or utilized by someone other than the Customer or the Customer has reason to believe that any of these circumstances has occurred. The Customer will be responsible for all bets placed with BetFlash and any payments made by/to BetFlash in respect of any purchase and/or transaction concluded on the Customer’s account before the Customer has notified BetFlash that any of these circumstances has occurred.
    4. The Customer undertakes that he/she shall not permit or enable any other person to place a bet, directly or indirectly, by making use of such account reference number, user name or personal identification number as is or may be furnished to the Customer by BetFlash from time to time and BetFlash shall accordingly not be liable to pay out any winnings in respect of any bet so placed. The Customer indemnifies BetFlash against any claims, losses or damages arising from such bets.
  7. Deposits
    1. The Customer acknowledges that the cash or credit card deposits referred to in Rule 2.3 will be held and applied as security for the discharge by the Customer of any amount which may become owing by the Customer to BetFlash.
    2. The Customer may make or authorise cash deposits or credit card deposits into his/her Player Account at any time.
    3. Cash deposits may be made –
      1. by an electronic transfer of funds into BetFlash’s banking account. In such cases, the Customer is required to transmit proof of transfer of the relevant funds, reflecting the amount transferred and the Player Account Number of the Customer, to –
        1. finance@betflash.co.za , in the case of transmission by e-mail.
      2. By depositing cash directly into the banking account of BetFlash. In such cases, the Customer is required to transmit proof of deposit of the relevant funds, reflecting the amount transferred and the Player Account Number of the Customer, to –
        1. finance@BetFlash.co.za , in the case of transmission by e-mail.
    4. Where the Customer makes a direct deposit into the banking account of BetFlash, as contemplated in 7.3(b), a clearing period of 48 hours will apply before the funds are allocated to the Player Account of the Customer, during which period no bets will be accepted against any such amount(s) deposited.
    5. Credit card deposits may only be made by the cardholder whose name is displayed on the credit card, which must match the name in which the Player Account is held, unless by verbal agreement between the Parties duly recorded on a telephone line.
    6. Credit card deposits can be made using Visa, Mastercard, Diners Club or American Express –
      1. on the BetFlash website, in “My Account”
    7. BetFlash reserves the right to charge a 5% administration fee on amounts deposited by credit card.
    8. Once a Customer has committed a payment to BetFlash via his/her credit card, and pending payment of such amount into BetFlash's banking account, the Customer shall remain personally liable to BetFlash for any such amount, which shall under no circumstances be construed as the extension of credit to the Customer for the purposes of engaging in betting.
    9. Cheques made out in favour of BetFlash may be accepted as payment; provided that the allocation of any such funds to the Player Account of the Customer shall take place only once the funds have been cleared by BetFlash’s bankers, during which period no bets will be accepted against any such amount(s) paid.
    10. The Customer is entitled to replenish any cash deposit referred to in these Terms at any time.

  8. Payment of Winning Bets

    1. BetFlash shall credit the Customer’s Player Account in respect of winnings and refunds accruing to the Customer in consequence of bets placed on an ongoing basis.
    2. In the event that funds are incorrectly credited to the Customer’s account, the Customer shall be obliged to notify BetFlash of the aforesaid error without delay.  Any betting transactions processed on the strength of such error, which cannot be financed by the funds actually standing to the credit of the Customer’s Player Account, shall be void.
  9. Withdrawals

    1. If the Customer wishes to effect the withdrawal of any amount standing to the credit of his/her Player Account, the Customer shall request a withdrawal, by completing the Winners Payout Form posted on the website of BetFlash.
    2. Upon receipt of a duly completed Winners Payout Form referred to in Rule 9.1, BetFlash shall –
      1. perform such investigation as may be required to confirm that the amount requested by the Customer, after effecting all deductions or adjustments which may be required, is available to be transferred from the Customer’s Player Account to the banking account nominated by the Customer in the Player Account application form or specified in a subsequent written notice signed by the Customer and delivered to BetFlash;
      2. if the requested amount is not available in the Customer’s Player Account, inform the Customer in such manner as BetFlash may deem fit, that the request has been declined;
      3. in the event that the requested amount is available in the Customer’s Player Account, within 24 hours of confirming the availability of such amount, effect the electronic transfer of the requested amount from the Player Account of the Customer to the account nominated by the Customer; provided that, for the purposes of this Rule, BetFlash shall be deemed to have fully complied with its obligation to effect such transfer at the time of giving the instruction to its bankers to effect such transfer and the 24-hour period contemplated in this Rule shall not include such further period as may elapse before the requested amount is deposited into the banking account nominated by the Customer for this purpose, and
      4. immediately reduce the balance standing to the credit of the Player Account of the Customer by the amount so transferred.
    3. The Customer shall be solely responsible for ensuring the accuracy of the information supplied in any Winners Payout Form referred to in Rule 9.1 or any nomination or notice contemplated in Rule 9.2(a), and by submitting such Winners Payout Form, nomination or notice, shall be taken to have warranted the accuracy thereof. BetFlash shall accept no liability for the payment of any amount requested into any banking account based in whole or in part on incorrect information provided by the Customer.
    4. The Customer acknowledges that –
      1. BetFlash will process Winners Payout Forms only between the hours of –
        1. 09h00 and 16h00 (CAT) on Mondays to Fridays (inclusive); provided that any such day is not a public holiday officially recognised as such in South Africa.
      2. any amount transferred into his/her banking account by BetFlash pursuant to Rule 9.2(c) may be subject to a clearance period before becoming available to the Customer.
  10. Recovery of Amounts Owing

    1. In the event of a debit balance in the Customer’s Player Account owing to the acceptance of a bet in excess of the credit or deposit limit, the Customer shall, on a weekly basis, make payment in full to BetFlash of such amount either –

      1. by depositing the relevant amount directly into the banking account of BetFlash, in which event –
        1. the Customer’s Player Account number must be entered onto the base of the deposit Slip; and
        2. a copy of the deposit slip must be forwarded to BetFlash by the Customer, or
      2. by furnishing BetFlash with written authorisation, in such format as BetFlash shall require, for the recovery by BetFlash of the relevant amount from the Customer’s credit card company.
    2. BetFlash may at its own discretion and from time to time determine how payments by the Customer to BetFlash shall be appropriated in respect of amounts owing the Customer to BetFlash.
    3. A certificate signed by any director, manager, assistant manager, trader or accountant of BetFlash (whose appointment or authority need not be proved) stating the amount of the Customer’s indebtedness to BetFlash, shall be prima facie proof of such indebtedness.
  11. Adjustments

    1. BetFlash may at any time adjust or cancel the Customer’s credit limit.
    2. Notwithstanding anything to the contrary herein contained, BetFlash shall be entitled to set-off any amount(s) due by the Customer against any funds standing to the credit of any of the Customer’s accounts with BetFlash or to realize any security held by BetFlash and to use the proceeds towards payment of any amount due by the Customer to BetFlash.
  12. Suspension or Termination of Betting Facilities

    1. BetFlash shall have the right prior to accepting any bet, temporarily to suspend or permanently to terminate, the furnishing of betting services to a Customer without providing any reason.  Upon such suspension or termination –
      1. BetFlash shall upon the demand of the Customer, refund to the Customer the balance of any monies held by BetFlash on deposit for the Customer, after adjusting for losses, winnings and taxes and once such funds have been cleared into BetFlash’s bank account;
      2. any amounts owing by the Customer to BetFlash shall become payable immediately.
    2. The Customer shall upon written notice to BetFlash be entitled to terminate its contractual relationship with BetFlash at any time after final conclusion of any betting transaction placed by the Customer and after payment by the Customer of all amounts owing by the Customer to BetFlash.  BetFlash shall within a reasonable time after such termination, refund to the Customer the balance of any monies held by BetFlash on deposit for the Customer, after adjusting for losses, winnings and taxes.
    3. BetFlash shall accept no further bets on account from a Customer in respect whom the provision of services pursuant to these Rules has been terminated, unless and until a fresh account application form has been submitted by the Customer and accepted by BetFlash.
  13. Placement of bets

    1. BetFlash may in its sole discretion elect whether to accept or to reject a bet requested by a Customer, or any component thereof.
    2. Bets may be placed, and shall be accepted at such times as BetFlash may elect –
      1. on the website of BetFlash;
      2. on the mobile betting platform, using the telephone number furnished by BetFlash from time to time, or
      3. via such other electronic media as may be made available by BetFlash for this purpose from time to time.
    3. The Customer authorizes and consents to each telephone conversation or electronic communication relating to any bet placed being recorded by BetFlash in such manner as BetFlash deems fit and to retain such recording for such period as may be prescribed by law, or as BetFlash may deem necessary. The Customer acknowledges that BetFlash is required to keep such recordings by law and that such recordings may be used by BetFlash for the investigation and resolution of disputes which may arise between itself and the Customer or for any other lawful purpose.
    4. The Customer shall bear the responsibility of ensuring that the bet is accurately placed and recorded by BetFlash. BetFlash shall furnish such confirmation of a bet to the Customer as may be required by law or reasonably requested by the Customer.
    5. The Customer shall be responsible for ensuring that he/she has full knowledge of the Rules applicable to the market within which the Customer proposes to place a bet, which are available at www.BetFlash.co.za/Betting_Rules and which may be procured from BetFlash on written request.
    6. The placement of a bet signifies the Customer’s acceptance of the Rules published by BetFlash in respect thereof and of these Terms and Conditions.
    7. Bets shall be subject to such limits as may be determined and displayed in these Terms and Conditions or posted on the website of BetFlash from time to time. It is the responsibility of the Customer to establish the prevailing limits prior to betting on any contingency. Erroneously accepted bets which exceed the prevailing limits may be adjusted at the sole discretion of BetFlash.
    8. Online bets are subject to a limit of a R25 000 win per bet per client. Multiple bets are limited to a maximum win of R50 000 per bet per client. There is a daily limit on winnings of R250 000 per client per day.
    9. Any bet alleged to have been placed in respect of which the details are not –
      1. recorded on or reflected by BetFlash betting terminals or wagering software, or
      2. confirmed by voice recording devices, will not be recognized by BetFlash.
    10. The time of acceptance of a bet shall be the time at which such bet was recorded on BetFlash betting terminals and/or wagering software used by BetFlash.
    11. Bets on all events are accepted for regular time, unless otherwise specified in these Rules.
    12. Any betting transaction between BetFlash and the Customer will only be valid once the bet has been accepted by an employee of BetFlash situated at a licensed premises operated by BetFlash, or electronically by a software programme operated from any such premises irrespective of the origin or physical location of any telephone call or electronic signal used to make bets. Such a bet will be deemed to have been placed at such licensed premises.
    13. While BetFlash will endeavour to ensure complete accuracy in relation to the announcement, publication and issue of prices, off-times (starting times of events) and results, it does not accept responsibility for any errors which may arise in this regard, unless caused by intentional conduct or serious negligence by BetFlash. BetFlash reserves the right to correct any such errors in any manner it deems fit. The Customer indemnifies and holds BetFlash harmless in respect of any losses, whether potential or actual and direct or indirect, which may be suffered in consequence of any such error. Any such losses will be for the account of the Customer and there will be no claim against BetFlash.
    14. Any bet accepted after the “off” or starting time of the event on which bet is placed (other than bets in-running) will be of no force or effect. Any bets taken on results already known at the time of the placement of such bets will be cancelled by BetFlash.
    15. Additional or new markets may be made available by BetFlash from time to time. It is the Customer’s responsibility to read the "Betting Rules" applicable to those markets before placing any bets.
    16. The Customer will under no circumstances place a bet or attempt to place any bet which, calculated together with any other bets then outstanding, exceeds the Customer’s credit balance with BetFlash, or the net amount on deposit with BetFlash (after all adjustments in respect of taxes, winnings and losses up to the time of placing of the bet). It will be the Customer’s responsibility before placing a bet to determine whether their credit balance or cash deposit will be exceeded by placing a bet.
    17. If, owing to a system malfunction or for any other reason, BetFlash accepts a bet referred to in Clause
      13.16, it will be entitled at its election either before, during or after the outcome of the event or contingency upon which the bet was placed, to honour the bet or to refund the Customer’s stake in respect of the bet without regard to any winnings on such a bet. Alternatively, BetFlash may restrict the size of any stake without notification to the Customer, to ensure that the credit limit or deposit is not exceeded.
    18. Acceptance by BetFlash of a bet over the credit or deposit limit, as the case may be, will not prevent BetFlash from exercising its rights –
      1. to collect from the Customer all amounts (including losses) arising from such bet, or
      2. to enforce the appropriate deposit limits at any later time.
  14. Cut-off time to accept and process bets

    1. BetFlash shall, subject to the provisions of the relevant legislation, close all betting on an event or a component within an event on which the bet is sought to be placed within thirty seconds after the event or component of the event has officially started, provided that where the event or component of the event is expected to last less than thirty seconds, betting shall be closed at the commencement of the event or component of the event.
    2. No ticket with respect to horseracing shall be issued after the official starting time, and any ticket so issued shall be deemed void for the purpose of these Rules.
    3. BetFlash shall not be liable if the Customer is unable to place a bet due to congestion on the telephone lines, telephone system, telephone exchange, or such other electronic communication media as may be approved for use for the purposes of betting.
  15. Contingencies on which betting is offered

    1. BetFlash will, in its sole discretion, determine the markets, events or contingencies on which betting will be offered.
    2. Subject to any minimum or maximum amount prescribed by law, BetFlash may from time to time determine a minimum or maximum amount that may be staked as a bet in respect of any market, whether in general or in any given case. It is the Customer’s responsibility to enquire before placing a bet on a market whether there is a maximum or minimum bet applicable to that market and, if so, what the amount is.
    3. Subject to any minimum or maximum amount prescribed by law, BetFlash may determine minimum or maximum amounts that a Customer may win or lose in respect of a bet (referred to as “limits”, “stop wins” or “stop losses”), whether in general or in any given case. It is the Customer’s responsibility to enquire about applicable limits, stop wins or stop losses and the extent thereof before placing a bet on a market.

    8. Notwithstanding the aforesaid limits, where the selection of multiple bets is made from the different categories listed, the lowest daily maximum win limits recorded in the table will apply.
    9. The maximum amount that any single Customer may win (directly or indirectly) from any bet or combination of bets placed with BetFlash on any one day, irrespective of the stakes in respect thereof or the terms of such bet(s), is set out above but always subject to a maximum of R250 000 per Customer per day. Where bets have been placed on different days in respect of an event or events held on the same day, the maximum amount that one Customer may win on one day’s trading is determined by the day on which the event/market in question is finalised, and not on the day on which each bet was placed and accordingly limited to a maximum amount of R250 000 per customer per day.
    10. Notwithstanding 15.9 above, bets that have been placed on Soccer as defined in leagues "B & C" above, will be subject to a daily limit of R100 000.
    11. Any bet or bets placed by a Customer in respect of which the potential payout exceeds the payout limits specified in these Terms (and accepted by BetFlash) will be paid out subject to the payout limits prescribed above.

       

  16. Bets “in-running”

    1. BetFlash may, in its sole discretion, from time to time offer the opportunity to Customers to place bets during the course of a certain event (referred to as “bets in-running”), provided that –
      1. the event does not form part of a series of events over a period of time; and
      2. the relevant event is televised.
    2. The nature and extent of any spreads offered by BetFlash will be determined from time to time at the sole discretion of BetFlash and it will be the Customer’s responsibility to enquire, before placing a bet, what the ruling spread is.
  17. Suspension or Termination of Betting Facilities

    1. BetFlash shall have the right prior to accepting any bet, temporarily to suspend or permanently to terminate, the furnishing of betting services to a Customer without providing any reason.  Upon such suspension or termination –
      1. BetFlash shall upon the demand of the Customer, refund to the Customer the balance of any monies held by BetFlash on deposit for the Customer, after adjusting for losses, winnings and taxes and once such funds have been cleared into BetFlash’s bank account;
      2. any amounts owing by the Customer to BetFlash shall become payable immediately.
    2. The Customer shall upon written notice to BetFlash be entitled to terminate its contractual relationship with BetFlash at any time after final conclusion of any betting transaction placed by the Customer and after payment by the Customer of all amounts owing by the Customer to BetFlash.  BetFlash shall within a reasonable time after such termination, refund to the Customer the balance of any monies held by BetFlash on deposit for the Customer, after adjusting for losses, winnings and taxes.
    3. BetFlash shall accept no further bets on account from a Customer in respect whom the provision of services pursuant to these Terms has been terminated, unless and until a fresh account application form has been submitted by the Customer and accepted by BetFlash.
  18. Bets finally determined

    1. A bet shall be deemed to have been finally determined, and in the case of winning bets, shall be payable by BetFlash, when the outcome of the event or contingency in respect of which such bet was placed has become known. Any bets accepted or laid once the outcome of the event to which such bets relate has become known, shall be void.
  19. Collection of winning bets

    1. If any winning bet payable by BetFlash is not collected within a period of 90 days from the date on which the event or contingency on which such bet was placed, took place, such bet a shall be payable at the discretion of BetFlash, provided that any tax payable in respect of such a bet has been paid.
    2. All winning bets in respect of horseracing are subject to taxes and levies imposed by the provincial government (currently collectively 6%).  Taxes and Levies shall be retained by BetFlash and paid over on behalf of the player.
  20. Connected bet

    If a connected bet is laid by BetFlash, the odds on that bet may be reduced by an amount agreed by BetFlash and the Customer at the time the bet is struck
  21. Related bet

    If a related bet is laid by BetFlash, it will be settled by equally dividing the stake unit where related outcomes clash.
  22. Key bet

    1. The odds for a key bet are calculated as a percentage of BetFlash’s fixed odds win price, depending on the number of runners.
    2. In the event of a scratching, where the race has four runners or fewer:
      1. Key bets that do not form part of an ATC, are void, and
      2. Key bets that are included in the ATC will be recalculated by excluding the key bet leg.
    3. When laying key bets, BetFlash shall display prices on its website.
  23. Confidentiality of betting transactions

    All betting transactions between BetFlash and a Customer or another bookmaker shall be strictly private and shall not be divulged to any third party other than –

    1. an officer or an inspector appointed in terms of the relevant legislation,
    2. police official as defined in section 1 of the Criminal Procedure Act, 1977 (Act 51 of 1977),
    3. a person specially authorised thereto in terms of any legislation,
    4. pursuant to the terms of an order of a competent court compelling such disclosure, or
    5. with the consent of the Customer.
  24. Void bets

    1. In the case of a void bet the stake money shall be returned to the Customer.
    2. In the case of an invalid selection in a single bet, the bet shall be void.
    3. In the case of a scratched selection in a single bet, the bet shall be void, except where the bet was an ante-post bet.
    4. In the case of an invalid selection and subsequent scratching in a multiple bet, the selection shall be ignored and the stake shall run onto the other selection in the bet at the price indicated on the ticket issued. These calculations are to be done at “Full Accumulative Multiple” odds.
  25. Possibility to win

    1. In all cases there must be a possibility for either party to win at the time the bet is made, failing which the bet or the affected selection, as the case may be, shall be void.
    2. All bets on contingencies which have already been finally determined at the time of the placement thereof shall be void.
  26. Acceptance of bets

    1. BetFlash is not obliged to accept any bet or any type of bet.
    2. A bet shall be deemed to have been concluded by BetFlash when BetFlash has indicated to the Customer that the bet has been accepted.
  27. Error

    1. Where due to a mutual error the parties to a bet are not ad idem (in agreement ) as to the odds at which the bet is struck, the amount of the bet or the contingency on which the bet is placed, that bet shall be void.
    2. Where due to a unilateral (one-sided) error the parties to a bet are not ad idem (in agreement) as to the amount of the bet or the contingency or selection on which the bet is placed, the bet may be cancelled or renegotiated by the party that did not make the error.
    3. Should there be an official correction of a price which had earlier been wrongly transmitted, all bets struck at that price shall be settled at the corrected price or starting price, whichever is the greater.
    4. Should BetFlash misstate any odds of a bet to a Customer as a result of a system or computer malfunction, the bet or selection will be deemed to have taken place on the correct price/s which were available in the general market at the time the bet was struck.
  28. Settling

    BetFlash shall pay out winning bets as follows:

    1. in respect of horseracing, after the “all clear” has been given;
    2. in respect of other sporting events or contingencies, once the medal ceremony, prize giving or podium presentation has been concluded; and
    3. subsequent disqualification, promotion of competitors, or any other change shall be irrelevant for the purposes of determining the betting result.
  29. Rules for other contingencies

    In all betting relating to contingencies other than horseracing and sports, the Rules set out above shall apply with the necessary changes to all circumstances not specifically covered in these Rules.

SECTION B - BETTING RULES FOR HORSERACING

  1. Ante-post bets

    1. With the exception of starting price bets, should any selection not run for any reason other than the abandonment of the race itself –
      1. an ante-post bet shall be lost and the Customer shall forfeit his stake; and
      2. ante-post bets struck on other horses/contestants in the race concerned shall not be subject to any adjustment in betting odds.
    2. Where a race is abandoned, all ante-post selections that are still live or undetermined involving the race concerned, shall become void.
    3. Should a selected horse/contestant in any leg of a multiple event bet be scratched, withdrawn or not accepted prior to the bet becoming void or being won, the bet shall be regarded as lost, notwithstanding the fact that any included race has been abandoned.
  2. Display of odds .

    1. When laying ante-post bets, BetFlash shall display the prices on its Internet Website, and indicate a price against the name of each and every horse/contestant in the race.
    2. In all races on which BetFlash is laying bets, a price shall be shown against each and every horse not officially scratched.
    3. Doubtful starters shall be indicated as such.

  3. Betting “with a run” .

    1. Where a single bet is made “with a run” and the selected horse/contestant is scratched the bet shall become void.
    2. All bets struck “with a run” on the remaining horses/contestants in a race where one or more horses/contestants have been scratched, shall be subject to the deductions detailed in Rule 33.
    3. Where a deduction applies to remaining runners in any event of a multiple event bet “with a run”, the relevant deduction in terms of Rule 33 shall be applied to the runner/contestants of the event where the scratching occurred, and the entire bet recalculated in respect of the event from which the horse was scratched.
    4. Any bets “with a run” stuck after the official announcement of the withdrawal of one or more horses/contestants shall not be subject to any deduction, unless there is a further withdrawal or withdrawals.
    5. Where a race is abandoned, all selections “with a run” on the race concerned shall become void.32.6. In starting price multiple bets “with a run”, winnings on winning bets shall be calculated and paid at the official starting prices, subject to the provisions of Rule 36.


  4. Deductions .

    1. Where a horse/contestant is withdrawn before or after coming under starter’s orders, all fixed odds bets on that horse/contestant shall be void, and all bets struck as fixed odds on the remaining horses/contestants on the day of the race or “with a run” shall be subject to deduction calculated in accordance with the following table –

      Note: Any prices that fall between two ranges will default to the lower deduction percentage.

    2. Any bets struck “with a run” after the official announcement of the withdrawal of one of or more horses/contestants shall not be subject to any adjustment unless there are further withdrawals.
    3. Should two horses/contestants be withdrawn simultaneously where both are subject to a deduction on any winning bets, the deductions shall be applied separately and not simultaneously.
    4. Deductions shall not apply to starting price bets, unless a late withdrawal(s) occurs.
  5. Postponed races

    Where a race advertised to be run on a certain date is postponed to any future date –
    1. all ante-post bets on such race shall stand;
    2. within 48 hours after the original advertised date at the same venue, all bets “with a run” shall stand;
    3. more than 48 hours after its initial scheduling, the race shall be deemed to have been abandoned for betting purposes, and bets “with a run” shall be treated as described in Rule 31.
  6. Change of venue or track

    Where the venue of a race or track is changed from that originally advertised, the race shall be deemed to have been abandoned and the provisions of Rule 34 shall apply mutatis mutandis .
  7. Dead heats

    1. In the case of a dead heat in a match race, the bet shall be void, unless odds were offered on the outcome being a dead heat.
    2. If two horses/contestants dead heat in races other than “match races”, and in the case of winning multiple event bets where one race results in a dead heat, the Customer shall lose half of the amount staked and the entire bet shall then be recalculated.
    3. In winning multiple events bets where two races result in dead heats, the Customer shall win the odds to one quarter of the stake and lose the other three quarters, and so on, for further dead heats.
    4. Notwithstanding the provisions of Rule 36.2, in the case of a three horse/contestant dead heat in a multiple event bets, where one race/event results in a triple dead heat, the Customer shall lose two-thirds of the odds in the event where the dead heat occurs and lose two thirds of the stake and the entire bet shall be recalculated.
  8. Starting prices and totalisator odds

    1. In starting price bets, the starting price shall be the last official fixed price disseminated either from the race track or recognised dissemination facility, as displayed on the BetFlash website at the start of the event.
    2. In the event of a late withdrawal where no new betting is displayed before the start of a race, the starting price shall be the last price displayed, subject to the adjustment reflected in the deduction table in Rule 33.
    3. Unless otherwise stipulated in the form of limits, any place betting at totalisator odds shall be settled in accordance with totalisator dividends. BetFlash can however pay more than the official totalisator dividend, if this was agreed to when the bet was struck.
    4. In starting price bets and open bets, any limits to actual dividends, odds and payouts which apply, shall be prominently displayed and be made available at all times by BetFlash.

  9. Open bets

    The following shall apply to “open bets” –
    1. all open bets offered by BetFlash shall be subject to such limits as may be determined by BetFlash if any;
    2. the limits and conditions applicable to any bet type shall be clearly displayed on the website or other relevant media of BetFlash.
  10. Place betting at fixed odds

    The following shall apply to place betting at fixed odds:

    1. in races with 6-7 runners, the 1st and 2nd place will be payable;
    2. in races with 8 or more runners, the 1st , 2nd and 3rd place will be payable;
    3. all place bets are subject to the Rules regarding scratchings, deductions and dead heats;
    4. when laying place bets, BetFlash shall display his prices on its website.
  11. Races re-run

    In the event of any race being ordered to be re-run –

    1. starting price bets shall be calculated and paid at the current price at the time the race is actually run;
    2. “with a run” bets on any horse/contestant, which started on the first occasion and which were subsequently scratched, shall be void and the deductions in terms of Rule 33 shall apply; and
    3. “ante-post” bets shall stand.

SECTION C - BETTING RULES FOR SPORTING EVENTS (OTHER THAN HORSERACING)

  1. Application of this section

    1. In all betting relating to sports, other than horseracing, the Rules relating to betting on horseracing shall apply mutatis mutandis to all circumstances not covered by the provisions of this section.
    2. The ‘Deduction Table’ contemplated in Rule 33 shall apply to this section.
    3. “Betting in running” or “live betting” shall apply to all sports and other contingencies.
    4. For settlement purposes in respect of sports event or contingencies, the medal ceremony, prize-giving or podium presentation will be the official result.
  2. Void bets

    Unless otherwise specified in the Rules applying to a specific sporting code, where a fixed odds selection is taken on an individual or team and such individual or team –
    1. is a “no show”;
    2. is eliminated prior to the event through injury or sickness;
    3. is eliminated from the competition due to a technical infringement, excluding mechanical breakdown, crash, fall or injury during the event, such selection will be void.
  3. Soccer (Football)

    1. All soccer bets shall be settled on the score at full time (90 minutes played plus referee’s optional time). Extra-time, golden-goal and penalties do not count.
    2. In the event of extra time, a new market may be created.
    3. Where a bet is struck ”to win outright”, “to lift the cup” or “to progress” there shall be no betting on the draw, as extra time, golden-goal or penalties may be required to decide the outcome.
    4. Prices shall be displayed on both teams as well as a draw. The price on the home team shall be displayed first and then the price on the away team, failing which it shall be clearly indicated in the line which team is the home team.
      1. If a team plays a different opponent to the one advertised, or if the venue of a match is the reverse of that displayed, or if the venue is changed to a neutral ground, all bets on that match shall become void. Multiple bets which include that match shall stand with that match being treated as void.
      2. If a match commences earlier than the scheduled kick-off time, all bets struck prior to the actual kick-off time shall stand and all bets struck after the actual kick-off time, other than live bets laid by BetFlash, shall be void.
      1. Where various betting opportunities are offered for the same match (e.g. correct score, first player to score, half-time or full-time result forecast) these cannot be combined in multiple bets where the outcome is related or where the result of one part of the bet contributes or assists in determining the outcome of another part of the bet. Where a multiple bet of this type has been accepted in error, it shall be settled by equally dividing the stake unit where the related outcomes clash; for example: Chelsea to win with the exact score 3-0 (10/1) and Chelsea to win in 90 minutes (1-1) is a related bet and therefore any bets placed on this double would be amended and the stake on the double split between the two individual bets; i.e. if R200 was placed on the double, the bet would be amended to read R100 on Chelsea to win 3-0 (1000/100) and R100 on Chelsea to win in 90 minutes (100/100).
      2. Where various betting opportunities are offered for the same tournament (e.g. pick the finalists, teams to proceed or not to proceed to further stages of the tournament, a team to win a group) these cannot be combined in multiple bets where the outcome is related. When a multiple bet of this type has been accepted in error, it will be settled by equally dividing the stake unit where the related outcomes clash.

      1. Should a match start and be abandoned prior to the completion of full time and an official result is declared by the governing association of the match or event within 24 hours, relevant bets will be determined on that result, notwithstanding any later changes to the result and/or error. However, in these circumstances, selections which are dependent upon the number of goals scored (including handicap bets) are void and shall be excluded from all Combination bets and System bets.
      2. If a soccer match is officially called off prior to its scheduled completion and an official match result is not declared by the relevant recognised governing body within 24 hours, selections not determined at the time the match is concluded shall be void, shall be excluded from all combination bets and System bets and shall be settled with odds of “1”. This does not apply to bets already determined at the conclusion of the match (e.g. first goal scorer).

      1. Settlement of “first or last player to score” bets, if offered by BetFlash, shall be based on the goal scorer credited with the goal. Own goals do not count.
      2. “First player to score” selections, if offered by BetFlash, shall become void if the selected player does not take part or takes the field as a substitute after the first goal has been scored.
      3. If a match is abandoned, “first player to score” bets will stand provided a goal has been scored.
      4. In respect of “first goal scorer” bets and “any other goal scorer” bets, the Customer will be deemed to have wagered on any player besides those quoted by BetFlash in respect of the event. Only players NOT quoted in this event will be taken into account for the “any other player” bets.
      5. For the purposes of determining the number of goals scored in any match and the settlement of any bet in respect of which the number of goals scored is a factor, own goals will be credited to the team in whose favour they are recognised.
      6. If BetFlash, at its discretion, lays bets on whether individually named players will score during a match, such bets shall be successful if the named player scores at any time during the match, irrespective of the juncture at which such player scores; provided that such player formed part of the starting line-up and provided further that such own goals as may be scored by that player shall not be included in the number of goals recognised by BetFlash for the purposes of any such bet.
      7. Any selections contemplated in (f) above in respect of a player who did not form part of the starting line-up shall be void and the money staked shall be returned to the Customer.
    5. Selections on any matches that are postponed by more than 24 hours after the advertised date, or in respect of which there is a change of venue, shall become void.
    6. Selections are accepted up to kick-off time. Any bet inadvertently taken after the kick-off time will be void.

      1. Bets relating to time will be settled according to the timing of the broadcaster’s clock.
      2. Where no clock is available, or the game is not on television, then all related bets will be settled according to the information published on the internet or by the Press Association.
    7. All “soccer specials” are offered as one bet and should any part of the special not be determined for whatever reason, then the whole bet is void as the option was offered as one bet (e.g. Ryan Giggs to score the first goal and Manchester United to win – if Giggs does not play then the bet is void).
    8. In all cases of bets on yellow cards, red cards are not counted, and if a single player was sent off for two yellow cards, only one yellow card will be counted. Yellow cards shown to coaches and substitute players are not counted.
    9. For cup tournaments consisting of several matches, a Customer may place bets on qualification for the next round. The qualification is determined on the aggregate of all matches held and is expressed as “Tournament Pass”.
    10. A Customer may bet on the “Individual Total" of a team (if odds are specified by BetFlash).
    11. For the purposes of betting on a double, hat trick or poker in a match, the Customer must predict whether one football player will score exactly 2 goals (double), 3 goals (hat trick) or 4 goals (poker). Own goals are not included.
    12. If team forfeits a match at any stage prior to the completion thereof, all bets, other than those which have already become finally determined at the time of such forfeiture, shall be void.
  4. Athletics and Swimming

    For settlement purposes the podium position or medal ceremony will count as the official result.

  5. Boxing

    1. In the event of a contest being postponed for more than 24 hours or should there be a substitution for one of the boxers, all selections will be void, unless the result of the bet taken has already become finally determined.
    2. A price may be offered for a draw and in the event of that occurring; bets on either boxer to win will be losing bets.
    3. If either boxer fails to answer the bell, his opponent will be deemed to have won the contest in the previous round for betting purposes.
    4. A points decision is effective on completion of the scheduled number of rounds. Where for any reason a points decision is awarded before the full number of rounds is completed, bets will be settled on the round in which the fight was stopped.
    5. If for any reason the number of rounds scheduled is changed, all “round by round” selections will be void.
    6. Notwithstanding anything to the contrary in these Terms, where a boxer is disqualified by reason of technical infringement such a low-blows, eye-gouging and head butting, such boxer will be deemed to have lost and all bets shall stand.

  6. Cricket

    1. Limited Overs (one day matches):
      1. In any limited overs match, all bets will be settled in accordance with official competition Rules, including matches where a reduction of overs takes place.
      2. If a match is abandoned due to outside interference and no official result is declared, all selections will be void, unless the result of the bet taken has already become finally determined.
      3. In a weather affected match, where the minimum number of overs necessary to declare a match or result has not been bowled, all selections on the game will be void, except those bets where the contingency on which the bet was placed has already been concluded.
      4. Bets on matches that are reduced in length but not abandoned, including live bets, will stand, provided that the match has been completed and an official result declared. This applies whether the result is determined by the Duckworth/Lewis method or any other form of calculation used to determine the official result.
      5. All total runs bets on a single innings will stand regardless of how many overs have been bowled; provided an official result is declared.
      6. Bets will stand for all postponed matches so long as they are played within 24 hours. If there is a change of venue or team selection, selections will be declared void.
      7. When a match is tied –
        1. top batsman, bowler and total bets shall stand, and
        2. match selections are void unless tie betting has been quoted.
      8. In “top batsman” and “top bowler” betting, and “runs scored by an individual batsman” or “wickets taken by individual bowlers” –
        1. selections on any player not in the starting eleven shall be void;
        2. selections shall become void in a match where at least one ball has not been bowled to both sides;
        3. top batsman and bowler bets will stand so long as the player is picked to play in the match irrespective of whether he bats/bowls or not and such players will be deemed to have scored zero runs and taken zero wickets respectively;
        4. head to head bets in this sub-Rule require at least one ball to have been bowled and a minimum of 25 overs to have been bowled or the relevant innings to have been completed to stand. In the event of a tie, head- to- head selections will be void.
        5. selections on an individual batsman’s runs will be void if he does not face at least one ball;
        6. dead-heat Rules apply in respect of bets placed on “top batsman/bowler” and “catches”;
        7. if a match is abandoned before a bowler can complete his allotted overs or take more wickets than the other bowler, selections are void.
    2. Five day matches –
      1. Top batsman/bowler Rules apply as for limited overs matches.
      2. At least one ball must be bowled for bets to stand, otherwise affected selections are void.
      3. If a match is officially abandoned due to outside interference and no official result is declared, undecided selections on the match shall be void.
      4. In the event of a tie, i.e. both teams have completed two innings each and have the same score, dead-heat Rules will apply, and bets on the draw will be losing bets.
    3. Series betting: Test or one day–
      1. Selections are void if the designated number of matches in the series is not completed, unless a sufficient number of matches has been played to determine the series.
      2. correct score selections shall become void if the stipulated number of matches is not played.
    4. Tournament or Series
      In a tournament or series, where a bet on an outright winner has been taken and the trophy is shared due to a tie or a no result, dead-heat Rules apply. However, selections on a team to win a final are void if the match ends in a tie.
  7. Golf


      1. Where a tournament which is scheduled for 72 holes and play is abandoned for any reason, all selections on the outcome of the tournament are void, unless an official result is declared by the relevant recognised governing body within 48 hours, or unless the result of the bet taken has already become finally determined.
      2. In the event that a tournament is abandoned prior to completion of the scheduled number of holes, any selections placed after the point in the tournament where no further play occurred shall be void.
    1. Where a tournament is suspended by the recognised governing body and no official result is declared under circumstances where the balance of the tournament is intended to be rescheduled, all bets not yet determined shall be held in trust by BetFlash until a result is declared by the relevant recognised governing body. In these circumstances, if a result is not declared within 7 days of the original scheduled commencement date; all selections not yet determined shall be void.

      1. All outright bets are settled on the player who wins the trophy and any play-off holes will be taken into account when determining the winner of a tournament.
      2. In the case of place bets where there is a tie after completion of the predetermined number of holes (subject to Rule 47.1 and 47.2 herein), the revised payout payable shall be calculated by –
        1. dividing the face value of the sports bet (the original payout and the original stake) by the number of competitors involved in the tie, draw or dead-heat, then
        2. multiplying the figure obtained in (i) by the number of official placings to be filled by the competitors involved in the tie, draw or dead-heat.

          Example 1: Tiger Woods wins a tournament, Ernie Els comes 2nd and Adam Scott, Retief Goosen, Vijay Singh and Michael Campbell finish in a tie for 3rd place. If the Customer has selected Scott to finish in the placings at 5/1 and wagered 1000/200, the original payout of 1000 would be divided by 4, leaving the face value of the bet at 250/50. The official placings filled by the competitors who have tied is 2 (assuming you are paying the top 4 places), viz: 3rd and 4th place, so the bet would become 500/100.

          Example 2 : Woods wins a tournament, Els and Scott tie for 2nd, Goosen, Singh, Campbell and Garcia tie for 4th. If the Customer’s wager was 2000/500 on Garcia to finish in the top 4, the bet would be adjusted to be 500/125.

    2. Selections shall become void on any player failing to tee off in the first round and subsequent withdrawals shall be deemed to be losers.
    3. A player who tees off is deemed “under orders” and all outright and match bets stand.
    4. The following applies to “make the cut” betting -

      1. for selection to stand, the selected player must play 36 holes (or 54 holes where the cut is made at that point), and
      2. a player is deemed to have made the cut if the player is eligible to play in the round after the cut has been made (even if he chooses not to). If a player is not eligible to do so (even if the Rules for the cut have been changed during the tournament) that player is deemed to have missed the cut.
    5. The following applies to tournament group betting -

      1. this is the betting on specified groups of players to achieve the lowest individual aggregate (or the best placing) for the whole tournament irrespective of how far each player progresses;
      2. selections shall become void on any player in that group who fails to start the tournament and deduction Rules shall apply on the remaining players in that group; and
      3. dead heat Rules applicable to horse racing shall apply if two or more players tie for 1st place in the group.
    6. The following applies to tournament match betting -
      1. this is betting on specified pairings to achieve the higher placing (or the lowest individual aggregate score) for the whole tournament, on a selected day or over a number of selected days;
      2. prices are quoted for the tie in match betting (i.e. both players to achieve the same overall score after 72 holes, inclusive of when the number of holes has been reduced providing that it is not fewer than 36 holes and an official result has been declared by the recognised governing body);
      3. if either player fails to take any part in the tournament, or if the specific round is abandoned, selections on that match shall become void;
      4. play-off holes do not count; unless the bet was made specifically to exclude the tie; i.e. one player to win outright against another in the tournament match betting scenario, and
      5. If one player misses the cut, the other is deemed the winner and where both players miss the cut, the player with the lowest score when the cut is made cut will be the winner.
    7. The following applies to two, three and four ball matches: -

      1. all bets are settled on the lowest single round score over the specified 18 holes play and all 18 holes must be completed;
      2. if a player starts a round but fails to complete it, all bets on that player will be losing bets regardless of score;
      3. all selections shall be void if the specified round is abandoned or if any one of the players fails to start the round;
      4. the dead-heat Rules applicable to horse racing shall apply for three and four balls if more than one player achieves the lowest score, unless a tie is quoted;
      5. a tie will be quoted for two-ball betting and where a tie occurs all bets on players are losing bets, unless it is clearly stated that betting is quoted with no tie;
      6. in the event of a player listed in a three or four-ball withdrawing before the event has started all selections on that specific three or four ball are void;
      7. If for any reason a player withdraws or is disqualified during the tournament after he has teed off (i.e. played one stroke), all bets will stand on that three or four ball;
      8. If 2 or 3 players are tied on the same score they will be settled as a dead heat for betting purposes, unless they are involved in a playoff, where the winner of the three or four ball is the golfer with the lowest finishing score. If all three or four golfers miss the cut the player with the lowest score will be deemed the winner.
  8. Motor racing
    1. In the case of championship betting –
      1. bets stand on all drivers whether or not they participate; provided that drivers must start at least one race.
      2. results will be determined based on the official points standings upon the initial declaration of the official result by the relevant recognised governing body of the final event for championship purposes. The championship result will not be affected by any subsequent protests, processes or amendments to placings.
    2. In the case of Grand Prix betting -
      1. for settlement purposes, the podium position or medal ceremony immediately after the race shall count as the official result. The result will not be affected by any subsequent protests, processes or amendments to placing;
      2. in the event that the number of laps in the race is reduced for any reason, bets will stand and the podium finish applied to determine the outcome of the event, and
      3. selections will be void on any driver who withdraws from the race prior to the commencement of the warm-up lap (also referred to as the formation or practice lap). Once the warm-up lap is underway, all contestants are “under starter’s orders” and all bets stand.
      4. In the case of “head-to-head” betting between two drivers or cars, if either or both fails to finish, the outcome will be determined in accordance with which car or driver has completed the most laps, even if the number of laps is reduced for any reason. In the event that both are accredited with completing the same number of laps, dead heat Rules apply.
    3. Any selections on the constructors’ title will stand whether they participate or not provided that one of the constructors’ cars must start at least one race.
  9. Rugby

    1. All rugby bets shall be settled on the score at full time (80 minutes play), plus referees optional time. Extra-time and penalties do not count.
    2. In the event of extra time, a new market may be created.
    3. Where a bet is struck “to progress” or “to lift the cup” or “to win outright” there shall be no betting on the draw, as extra time or penalties may be required to decide the outcome. In the event of both teams being tied after extra time has been played, dead heat Rules apply for betting purposes.
    4. Prices shall be displayed on both teams as well as the draw if applicable, and it shall be clearly indicated which is the home team.
    5. A handicap tie price if applicable will be quoted and if the game is a tie on handicap after 80 minutes, then all bets on both sides for the win will be deemed losers.
    6. If a team plays a different opponent to that which is advertised, or if the venue of a match is the reverse of that displayed, all selections on that match shall become void.
    7. Where various betting opportunities are offered for the same match (e.g. correct score, first player to score, half-time or full-time result forecast) these cannot be combined in multiple bets where the outcome is related or where the result of one part of the bet contributes or assists in determining the outcome of another part of the bet. Where a multiple bet of this type has been accepted in error, it shall be settled by equally dividing the stake unit where the related outcomes clash.
    8. Where various betting opportunities are offered for the same tournament (e.g. a team to win a group, a team to progress or not to progress to further stages of the tournament, pick the finalists or semi-finalists) these cannot be combined in multiple bets where the outcome is related or where the result of part of the bet contributes or assists in determining the outcome of another part of the bet. Where a multiple bet of this type has been accepted in error, it shall be settled by equally dividing the stake unit where the related outcomes clash.
    9. Should a match be incomplete, abandoned or postponed, all selections shall become void, unless it is resumed or played within 24 hours of the original scheduled date, or unless the result of the bet taken has already become finally determined.
    10. In the case of “first try-scorer bets” –

      1. Selections shall be void if the selected player is not in the starting line-up;
      2. if a match is abandoned, “first player to score’” bets shall stand provided a try has been scored;
      3. in cases where a price is offered on a penalty try within the relevant market, all bets on players to score the first try will be losers;
      4. in the event that betting on a penalty try is not included within the relevant market and the first try awarded is a penalty try, then the relevant bet will be determined on the basis of the try following the penalty try;
      5. bets stand regardless of whether the player who is the subject of the bet or any other player takes or leaves the field or is dismissed from the game; and
      6. “any other try scorer” means any player besides those quoted (having betting next to their name) in the event. Only players NOT quoted in this event will be taken into account for the “any other try scorer” bets.
    11. “Half-time/full-time” betting is applied to which team is winning at half-time and which team wins the match at full-time, with the option of the draw included in bet permutation.
    12. Any matches that are postponed by more than 24 hours after the advertised date or where there is a change of venue will be void for betting purposes.
    13. The provisions of Rule 32 shall apply mutatis mutandis .
  10. American Football

    1. The score at the end of play, including overtime, will be taken as the final result.
    2. Notwithstanding the provisions of paragraph (a), “first half/second half” double bets shall be settled at the conclusion of regulation time.
  11. Tennis

    1. A tennis match is deemed to have commenced with the first serve. However, if a match ends prematurely due to either player’s retirement or disqualification, all match selections are void, with the exception of live bets or other bets laid by BetFlash which have become finally determined prior to such retirement or disqualification.
    2. If a match is postponed and rescheduled, all bets stand. If the match is not played within 24 hours, match selections are void with the exception of live bets or other bets laid by BetFlash which have become finally determined at the time of such postponement.
    3. Bets stand regardless of any change of venue or court surface.
    4. For sets betting, if the match does not start or is unfinished due to either players’ incapacity or disqualification, the selections are void with the exception of live bets or other bets laid by BetFlash which have become finally determined prior to the abandonment of the match.
    5. In the event of a change in the total number of sets played, match bets will stand but set betting will be void.
    6. Ante-post bets struck on an outright winner for any Grand Slam or Championship title will be subject to a three-day run and deduction Rule, i.e. if a tournament starts on a Monday, bets taken from and including the Friday before the commencement of the tournament, should the player withdraw from that time (the Friday) until the Monday it commences and the balance of the field shall be subject to existing horse-racing deduction Rules. Any bets taken before the Friday (i.e. prior to three days before the scheduled start of the tournament) will be losing bets should a player withdraw for any reason whatsoever.

SECTION D - SPREAD BETTING

  1. Betting Rules for spread betting

    1. In this Rule, unless the context otherwise indicates, the term set out below shall have the following meanings –
      1. going high ” or “ buying ” means wagering that the result of a certain event will exceed the high point or offer price of the spread quote and “ has gone high ” or “ bought ” has a corresponding meaning;
      2. going low ” or “ selling ” means wagering that the result of a certain event will be below the low point or bid price of the spread quote and “ has gone low ” or “ sold ” has a corresponding meaning;
      3. spread bet ” means a bet laid by BetFlash on the contingency that the outcome of a certain event will fall outside a spread margin;
      4. spread margin ” or “ bid-offer price ” means the margin, expressed in points, set by BetFlash between a low high and a high low point of predicted outcomes of a certain event; and
      5. stop loss / win ” means the maximum amount of points on a spread market that can be won or lost.
      6. make-up ” is the final settlement price of a spread bet.
      7. mid-point ” is the average of the bid and offer price or the “go-high” and “go-low” price.
    2. A spread bet is placed by the Customer staking a stated amount of money per point and going high or low (buying or selling) and the amount won or lost is directly related to the fixed amount per point wagered.
    3. Each spread bet shall be subject to the stop loss/win set by BetFlash on each type of spread betting market offered by him.
    4. All stop losses/wins shall be displayed at all times in the betting room or displayed on the website of BetFlash and, at the request of the player, shall be read out to the player.
    5. A player shall lose if the outcome of the event falls within the spread margin or the side of spread margin opposite to that on which he wagered.
    6. The size of a player’s win shall be determined by taking the lesser of –

      1. the number of points difference between that point of the spread margin at which the player wagered and the stop loss/win on that side; and
      2. the number of points difference between that point of the spread margin at which the player wagered and the outcome of the event.
    7. The size of the player’s loss shall be determined by taking the lesser of –
      1. the number of points difference between that point of the spread margin opposite to that on which the player wagered and the stop loss/win on that side; and
      2. the number of points difference between that point of the spread margin opposite to that on which the player wagered and the outcome of the event.
    8. 52.8.

      1. In certain circumstances BetFlash may allow the player to close his bet by either taking a profit or cutting a loss.
      2. If a player has gone high and he takes his profit or cuts his loss, the size of the player’s win or loss, as the case may be, shall be calculated not with reference to the actual outcome of the event, but with reference to the difference between –

        1. the high point of the spread margin applicable when the bet was struck; and
        2. the low point of the spread margin applicable at the time that the profit is taken or the loss is cut, as the case may be.
      3. If a player has gone low and he takes his profit or cuts his loss, the size of the player’s win or loss, as the case may be, shall be calculated not with reference to the actual outcome of the event, but with reference to the difference between –

        1. the low point of the spread margin applicable when the bet was struck; and
        2. the high point of the spread margin applicable at the time that the profit is taken or the loss is cut, as the case may be.
    9. The nature and extent of any spreads offered by BetFlash shall be determined from time to time at the sole discretion of BetFlash and it shall be the responsibility of the Customer to enquire, before placing a bet, what the ruling spread is.
  2. Sport provisions

    Notwithstanding anything to the contrary in these Rules, the following provisions shall apply to Sports spread betting –

    1. In the case of football –

      1. for any bets on the time of an event (such as first goal, first throw) occurring in the match, settlement shall be determined by the official timing of the match where available, alternatively bets will be settled on market consensus.
      2. a bet on the total number of points that a team will attain during the season shall not be affected by any points deducted after the completion of the season; and
      3. in any bet on the total shirt numbers of the goal scorers in a match, the shirt number of any scorer of an own goal shall be added to the total of shirt numbers of the goal scorers in the team which is credited with the goal.
    2. In the case of cricket –

      1. all bets struck on the number of runs to be scored in the first innings of a one-day match shall be void if the side has not completed 90% of the original allocated overs or 90% of any reduction of overs, unless the team has been dismissed; and
      2. in respect of a bet on a match between two batsmen, each shall go in to bat, and at least one ball shall be bowled to each for the bet to be valid.
    3. In the case of golf, in a bet on finishing positions where a position is tied, the average of the number of places allocated to the players involved in the tie for such position shall be used: Provided that in a playoff, the winner of the playoff shall be the winner.
    4. In the case of motor racing, in any bet involving the winning margin of a Grand Prix race, that margin shall be rounded up or down to the nearest 1000th of a second.
    5. In the case of rugby –

      1. eight points shall be awarded for a penalty try on bets struck on the jersey numbers of try scorers; and
      2. every player shall retain his original number for the duration of the match.
    6. In the case of boxing, in any bet involving the finishing time of the fight, all rounds shall be three minutes, and the finishing time shall be rounded up or down to the nearest minute.
    7. In the case of horse racing, a bet on finishing positions across a race day shall be void should the race meeting be abandoned.

SECTION D - SPREAD BETTING

  1. Breach

    1. Should the Customer breach any of these Rules and fail to remedy such breach within 48 hours after receipt of written notice by BetFlash requiring the Customer to do so, BetFlash shall be entitled, without prejudice to any other rights it may have at law, forthwith to terminate its contractual relationship with the Customer and to terminate or suspend any bet placed by any such Customer, whether accepted or not, and/or to claim damages from the Customer.  In such event –

      1. all amounts owing by the Customer to BetFlash shall become payable immediately;  and
      2. BetFlash shall have a lien and right of retention over all monies of the Customer on deposit with BetFlash, pending settlement of such damages as may have been suffered by BetFlash.
    2. Notwithstanding the generality of the aforegoing, the Customer shall be deemed to be in default if –

      1. the Customer dies;
      2. the Customer commits any act of insolvency;
      3. the estate of the Customer is sequestrated;
      4. the Customer endeavours to compromise generally with his/her creditors;
      5. the Customer’s name is entered into the register of excluded persons contemplated in section 14 of the National Gambling Act, Act 7 of 2004.
    3. The Customer shall be liable for any legal expenses (including legal expenses on a client attorney scale, collection charges and tracing fees) as well as any amount of governmental tax including but not limited to value-added tax, which BetFlash may incur in recovering any amounts owing in respect of the Customer’s account or a result of the Customer’s breach of any of the conditions of use or the enforcement by BetFlash of any of its rights against the Customer.
  2. Limitation of Liability

    1. BetFlash shall not  –

      1. under any circumstances whatsoever be liable to the Customer if the Customer’s credit card company refuses to honour any claim lodged by BetFlash against the Customer’s credit card.  No dispute of whatever nature between a Customer and the credit card company shall exempt the Customer from his liability to BetFlash in respect of payment and the Customer shall not be entitled to instruct BetFlash to reverse a payment instruction that has already been made to the Customer’s credit card company;
      2. be responsible for –

        1. any failure, malfunction or delay of any electronic funds transfer unit or other credit card processing machine or its supporting or sharing network, resulting from circumstances beyond the control of BetFlash, or
        2. any damages, loss or expense which the Customer may suffer as a result thereof, and
      3. be liable for any loss or damage suffered by the Customer as a result of the unauthorized access to any data or as a result of incorrect information supplied through an electronic funds transfer unit or other credit card processing machine or its supporting or sharing network.
    2. The liability of BetFlash to the Customer for any damages sustained by the Customer from any cause whatsoever including any damages arising out of the negligence of BetFlash or that of its servants, agents or sub-contractors, shall in any event and under all circumstances be limited –

      1. in the event of damages relating to a bet, to the amount staked by the Customer in respect of such bet; or
      2. in respect of the account of the Customer with BetFlash, to the credit balance of such account at the time during which the damages are alleged to have occurred, after full adjustment for winnings, losses and taxes.
    3. Notwithstanding any other provisions in these Rules, BetFlash shall under no circumstances whatsoever be liable for any loss of profits, winnings or potential profits or winnings or any indirect or consequential damages sustained by the Customer, whether or not caused by the negligence of BetFlash, its agents or employees.
    4. Insofar as any of the obligations of BetFlash under these Rules are carried out by any its servants, agents, sub-contractors, associates or subsidiaries, the provisions of these Rules shall apply mutatis mutandis and each of them shall be exempted accordingly.
    5. Any acts of God, war, strike, lock-out or other labour dispute, fire, flood, explosion, the enactment, amendment or repeal of legislation, failure of electricity or any other supplies, failure of telecommunications, failure, theft or default of any computer hardware or software or any other equipment or any other similar or different cause beyond the reasonable control of BetFlash leading to the cessation and/or restriction of the operations of BetFlash, shall entitle BetFlash to postpone its obligations to the Customer in whole or in part, and in such event BetFlash shall not be responsible for any damages of any nature suffered by the Customer, whether directly or indirectly, as a result thereof and the Customer shall not be entitled to terminate its contractual relationship with BetFlash as a result of any such occurrence.
  3. Disclosure of Information

    1. The Customer acknowledges that BetFlash may be legally required to, and in such cases shall, disclose to any governmental bodies or regulatory agencies, information pertaining to the identity and personal particulars of the Customer, the Player Account of the Customer and the activity on such account.
    2. BetFlash is entitled to supply any relevant credit information pertaining to the Customer and his account with BetFlash to a credit bureau should BetFlash deem it necessary to supply said information, and the Customer shall have no right of recourse against BetFlash by reason thereof.
  4. Domicile of Parties

    1. The residential address furnished by the Customer on the account application form shall serve as his/her domicilium citandi et executandi for all purposes in respect of these Terms and Conditions.
    2. The physical address reflected in respect of BetFlash on its website, as amended from time to time, shall serve as its domicilium citandi et executandi for all purposes in respect of these Terms and Conditions.
    3. The Customer shall have the right to change its domicile by giving one week’s prior written notice to BetFlash of its change of address.
    4. Any notice given in terms of Rule 57.3. which:

      1. is delivered by hand to an officer or manager of BetFlash during the normal business hours of the addressee at its domicilium citandi et executandi , shall be deemed to have been received by BetFlash at the time of delivery; or
      2. is posted by pre-paid registered post to BetFlash at its domicilium citandi et executandi , shall be deemed to have been received by on the seventh day after the date of posting; or
      3. is transmitted by telefax to BetFlash at its domicilium citandi et executandi , shall be deemed to have been received on the date reflected on the facsimile transmission confirmation generated by the addressor’s facsimile machine.
  5. Patron disputes

    1. In the event that a dispute arises between a Customer and BetFlash in relation to the liability of BetFlash to pay alleged winnings to the Customer, and that dispute cannot be resolved between the parties, the dispute may be referred to the Western Cape Gambling and Racing Board (“the Board”) for resolution.
    2. BetFlash will inform the Customer that the dispute will be referred to the Board, and shall refer such dispute to the Board within forty-eight hours of having so informed the Customer.
    3. The Customer may however, of his or her own volition, refer a patron dispute to the Board for resolution.
    4. The Board shall conduct an investigation into the matter and shall thereafter resolve the dispute and communicate the outcome to the parties.
    5. If either BetFlash or the Customer is not satisfied with the resolution of the Board, such party may file a petition with the Board to hold a hearing to reconsider the resolution. 58.6. The Board shall hold such a hearing and shall determine whether the original resolution of the dispute should be confirmed, set aside or amended in any way.
  6. Taxes and levies

    All winning bets in respect of horseracing are subject to taxes and levies imposed by the provincial government (currently collectively 6%). Taxes and levies will be retained by BetFlash and paid over on behalf of the Customer.
  7. General

    1. These Terms constitute the whole agreement between BetFlash and the Customer and no agreements, representations or warranties, other than those set out herein, shall be of any force or effect.
    2. No addition to, variation, consensual cancellation or novation of any of the terms set forth herein and no express or implied waiver of any of the rights arising therefrom shall be of any force and effect unless reduced to writing and signed by BetFlash and the Customer or their duly authorised representatives.
    3. No indulgence granted by BetFlash to the Customer in regard to the enforcement of its rights under these Terms shall be construed as a waiver of such rights (unless expressly provided for as such in a written document signed by the indulgent Party) nor shall it prevent BetFlash from strictly enforcing its rights in the event of a subsequent breach thereof.
    4. No failure by BetFlash to enforce any provision of these Terms shall constitute a waiver of such provision or affect in any way BetFlash’s right to require performance in terms of such provision at any time in the future, nor shall any waiver of any breach of a provision nullify the effectiveness of that provision.
    5. Any promissory note, bill of exchange, or other negotiable instrument received by     BetFlash from the Customer shall not be a novation of the debt in respect which it is given and the Customer waives any remedies provided for by law in respect thereof.
    6. Any bet placed by the Customer shall be governed by the applicable provisions of the Western Cape Gambling and Racing Act, 1996 and any Regulations and Rules made in terms thereof, as amended from time to time. It shall be the responsibility of the Customer to ensure that he/she is aware of these provisions. Links to these resources are available on the BetFlash website.
    7. The Customer undertakes to ensure strict adherence to any policy, guideline or directive issued by the Western Cape Gambling and Racing Board relating to the Customer or to betting generally
    8. These Terms and the contractual relationship between the Customer and BetFlash shall be governed by the laws of the Republic of South Africa.
    9. If the Customer places of a bet from a location falling outside the South African Monetary Area, such bet shall be subject to all appropriate exchange control regulations and the laws of the foreign jurisdiction from which such communication originates and it shall be the responsibility of the Customer to ensure full compliance with same.  BetFlash makes no warranties and shall not be liable to the Customer if it is not able to remit any monies held by it to any account held by the Customer in a foreign jurisdiction.
    10. These Terms and Conditions may be amended from time to time, as a result of changing operational, legislative or regulatory requirements. It is the Customer’s responsibility to ensure that he/she is aware of all amendments thereto, which will be posted on the BetFlash website as and when they occur.

SECTION F:  LOYALTY REWARD PROGRAMME TERMS AND CONDITIONS

  1. This reward is available to all clients and is based on criteria and amounts as determined by BetFlash in its sole discretion from time to time.
  2. BetFlash clients may receive a bonus reward on a quarterly basis or at such interval as BetFlash determines and will be valid for a period of 30 days from the date of issue or announcement.
  3. Loyalty reward funds granted are “winnings-only” meaning that the stake (bonus amount) is not returned. Any bet placed after a loyalty reward has been granted that is successful, a client will be entitled to its winnings but the stake awarded via the loyalty reward will be returned and deducted from any remaining funds available.
  4. If a withdrawal request is made before these bonus conditions are met, all bonus funds as well as any money earned by wagering the bonus may be forfeited.
  5. The promotion is intended for recreational purposes. Should anyone be seen abusing the spirit of the bonus, BetFlash reserves the right to withdraw any bonus awarded, along with disqualifying that account holder from any further betting.
  6. The bonus given can be wagered on all events except markets in the same event or any markets related to an event as deemed by BetFlash.
  7. BetFlash reserves the right to cancel or withdraw this offer or change any of its terms at any time and without cause/notice. It also reserves the right not to allow certain account holders to be given a bonus with no obligation to provide reasons for making such a decision.
  8. BetFlash may from time to time in its sole discretion announce qualification criteria or allocate bonuses in respect of "refer a friend" (specific criteria applies, i.e. referred clients must actively participate), "spot an error on our website" (specific criteria applies i.e. only pricing or significant misstatements), marketing surveys and new registrations, all of which will be valid for 30 days unless specified differently. Where no specific criteria is published in respect of the latter bonuses issued, the conditions as stipulated in respect of the 15% First Deposit Bonus will apply with the necessary changes where applicable.
  9. All promotions listed/not listed above, will only be allocated its benefits once the stipulated FICA requirements have been met.
